What Steps are Involved With Probate

  • Identify the assets and liabilities of the deceased and contacting the various organisations to notify them of the death and requesting values at the date of death.
  • Entering those values on an Inheritance Tax form and calculating any Inheritance Tax due.
  • Submission of the Inheritance Tax forms and Probate Application.
  • Obtain the Grant of Probate.
  • Collecting in all assets and settling all liabilities of the estate.
  • Distribute the estate to the beneficiaries of the Will.
  • Submission of estate Returns.
  • Complete Estate Accounts.

Scope of Lyon Griffiths Involvement, Time and Fees

Lyon Griffiths are happy to offer a service which ranges from a tailored service whereby we only assist the Executors with specific aspects of the Probate and Estate Administration process to a fully managed ‘start to finish’ service where we deal with every aspect step along the way.

It is difficult to provide a timeline for the work involved because there are so many things that can affect the process.  A typical time frame for dealing with probate is 6 to 12 months but any number of things could happen along the way which could affect the length of time taken to deal with the process.  Naturally we look to communicate with clients on a regular basis to keep them informed.

At the outset and before we begin any work we will provide an estimate of the fees involved.  Furthermore we will keep you appraised as the case progresses and fees to date if required.  Our charges are based on the time taken to do the work and we have separate charges depending on the skill, knowledge and level of authority of the individual assigned to your case.  Whilst you will need to contact us directly for a specific quote below are some Case Studies to give you an idea of the price range involved.

Case Study 1

Obtaining a Grant of Probate (easily identifiable low value assets)

  • The Will was simple, assets well understood and easy to value.
  • There was no Inheritance Tax due.
  • Valuations were easily obtained with no complicating factors.
  • The “simple” Inheritance Tax form IHT205 was completed and a probate application made on behalf of the Executors.
  • The Executors dealt with the estate administration themselves.
  • Total fee ranged between £750 and £1,750 (Plus VAT)

 

Case Study 2

Obtaining a Grant of Probate (easily identifiable high value assets)

  • The Will was simple, assets well understood and mostly relatively easy to value.
  • Calculation of the Inheritance Tax due.
  • Valuations were reasonably easy to obtain with no or minimal complicating factors.
  • The more complex Inheritance Tax form IHT400 was completed and a probate application made on behalf of the Executors.
  • The Executors dealt with the estate administration themselves although some guidance was required.
  • Total fee ranged between £2,000 and £3,500 (Plus VAT).

Acting on Behalf of Executors – Fully Managed Estate Administration for Simple Estate

  • Identifying all the assets and contacting to notify of their death.

Disbursements

  • Probate Application Fees are £273, plus small additional charges for extra copies.

  • Land Registry Searches – up to £6 per property registered at the Land Registry.

  • Notification in The London Gazette and a local newspaper of the individuals death to protect against claims from unknown creditors - £300 to £500.

Compensation Scheme

In the unlikely event that we cannot meet our liabilities to you, you may be able to seek a grant from ICAEW’s Compensation Scheme.  Generally, applications for a grant must be made to ICAEW within 12 months of the time you become aware, or reasonably ought to have been aware of the loss.  Further information about the scheme, and the circumstances in which grants may be made, is available on ICAEW’s website:

Complaints

We look to provide clients with a high level of service but should you feel that we have not delivered on this, please let us know by contacting the head of legal practice / probate contact partner James Stokes. 

We will consider carefully any complaint that you may make about our probate services as soon as we receive it and will look to resolve the issue.  We will acknowledge your complaint within five business days of its receipt and endeavour to deal with it within 8 weeks.  Any complaint should be submitted to us in writing.

Compensation Scheme

If we do not deal with it within this timescale or you are unhappy with our response you may of course take the matter up with our professional body, ICAEW, and the Legal Ombudsman. Complaints to the Legal Ombudsman should be made within six years of the act or omission or within three years of you becoming aware of the issue, and in either case within six months of our written response to your complaint to us.  The contact details for the Legal Ombudsman are:
